ALIMONY
In divorces, one party may be ordered to pay alimony (known as spousal maintenance in Texas) to the other.
In Texas, to be eligible:
1. The duration of the marriage must have been at least 10 years,
2. The spouse seeking maintenance lacks sufficient financial resources (including property awarded in the divorce proceeding) to provide for his/her minimum reasonable needs. AND
3. The spouse seeking maintenance
-
is unable to support self because of an incapacitating disability, or
-
is the custodian of a child from the marriage who requires substantial care due to a disability, rendering it necessary that the spouse not be employed outside, or the home, or
-
lacks earning capacity adequate to provide support for her minimum reasonable needs
